Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Swiss Digital Flow document automation platform (the "Service"), operated by Swiss Digital Flow, Zürich, Switzerland ("we", "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy.
1. Account
You must provide accurate information and keep your credentials confidential. You are responsible for all activity under your account. You must be at least 18 years old and authorised to bind your organisation.
2. Subscriptions & Billing
- The Service is offered on a free tier and paid subscription plans. Prices and limits are shown on our pricing page.
- Paid subscriptions are billed in advance on a recurring monthly basis through Stripe.
- Fees are non-refundable except where required by mandatory law. Unused allowances do not roll over.
- We may change prices for renewal periods with at least 30 days' notice.
- Taxes (VAT/MWST) are added where applicable.
3. Cancellation
You may cancel your subscription at any time from the billing settings. Cancellation takes effect at the end of the current billing period; the Service remains available until then. We may suspend or terminate your account for material breach of these Terms or non-payment.
4. Acceptable Use
You agree not to:
- upload content that is illegal, infringing, malicious or violates third-party rights;
- attempt to gain unauthorised access, reverse engineer or disrupt the Service;
- use the Service to send spam or to process data without a lawful basis;
- exceed plan limits via automated means or share accounts to circumvent quotas.
5. Your Content
You retain all rights to the documents and data you upload ("Customer Data"). You grant us a limited licence to host, process and display Customer Data solely to provide the Service. We do not use Customer Data to train AI models.
6. Service Availability
We aim for high availability but do not guarantee uninterrupted operation. We may perform scheduled maintenance and will make reasonable efforts to announce it in advance.
7. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the fees you paid to us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential or special damages, including loss of profits, revenue or data. Nothing in these Terms excludes liability that cannot be excluded under Swiss law (e.g. for gross negligence or wilful misconduct).
8. Warranty Disclaimer
The Service is provided "as is" and "as available". We do not warrant that AI-generated outputs (OCR, classification, extracted fields) are accurate or complete. You are responsible for reviewing results before relying on them.
9. Confidentiality & Security
We treat Customer Data as confidential and apply the security measures described in our Privacy Policy.
10. Changes to the Service or Terms
We may update the Service and these Terms. Material changes will be announced at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
11. Governing Law & Jurisdiction
These Terms are governed by the substantive laws of Switzerland, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Zürich, Switzerland, subject to mandatory consumer-protection venues.
